Agreement to Terms of Use

This Agreement becomes effective on the date you first use the Product Wait application.

Disclaimer

Product Wait does not warrant that the software will meet your requirements or that its operation will be uninterrupted or error-free. All express and implied warranties or conditions not stated in this Agreement (including, but not limited to, loss of profits, data loss or corruption, business interruption, or loss of contracts) are excluded and disclaimed, as permitted under applicable law. This Agreement does not affect your statutory rights.

Warranties and Limitation of Liability

Product Wait does not provide any warranty, guarantee, or other terms regarding the quality, fitness for purpose, or otherwise of the software. Product Wait shall not be liable to you for any representation (except fraudulent), implied warranty, condition, or other term, or any common law duty, for any loss of profit or any indirect, special, or consequential loss, damage, costs, expenses, or claims (whether caused by Product Wait's negligence or otherwise) arising out of or in connection with the provision of any goods or services. Product Wait shall not be liable or in breach of contract for any delay or failure to perform obligations if caused by factors beyond its reasonable control. Despite any contrary clauses in this Agreement, if Product Wait is deemed liable to you for breach of this Agreement, you agree that Product Wait's liability is limited to the amount actually paid by you for the services or software, based on this clause. You release Product Wait from any obligations, liabilities, or claims exceeding this limitation.

Billing and Renewal

Your subscription will continue and automatically renew unless canceled. You consent to our charging your payment method on a recurring basis without requiring your prior approval for each recurring charge, until such time as you cancel the applicable order. The length of your billing cycle will depend on the type of subscription plan you choose when you subscribed to the Services.

Cancellation

All purchases are non-refundable. You can cancel your subscription at any time by logging into your account. Your cancellation will take effect at the end of the current paid term. If you have any questions or are unsatisfied with our Services, please email us at [email protected].

Fee Changes

We may, from time to time, make changes to the subscription fee and will communicate any price changes to you in accordance with applicable law.

Term and Termination

These Legal Terms remain in effect while you use the Services. We may, at our discretion and without notice, deny access or use of the Services to anyone, including blocking IP addresses, for any reason or no reason, including breaches of these terms or applicable laws. We may also terminate your account or delete your content at any time, without warning.

If your account is terminated or suspended, you are prohibited from creating a new account under any name, including fake or borrowed names, or on behalf of others. We also reserve the right to pursue legal action, including civil and criminal remedies.

Prohibited Activities

You may not use the Services for any unauthorized purposes. This includes collecting data without permission, disrupting security features, uploading harmful content, or violating laws. Harassment, deception, and misuse of our support services are also prohibited. Additionally, do not attempt to bypass access restrictions or use automated systems to interact with the Services.

Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Services. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Services.

We cannot guarantee the Services will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Services, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Services at any time or for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Services during any downtime or discontinuance of the Services. Nothing in these Legal Terms will be construed to obligate us to maintain and support the Services or to supply any corrections, updates, or releases in connection therewith.

User Data

We will maintain certain data that you transmit to the Services for the purpose of managing the performance of the Services, as well as data relating to your use of the Services. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Services. You agree that we shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against us arising from any such loss or corruption of such data.

User Generated Contributions

Product Wait is not responsible for the use of user-generated content. Contributions must not be false, inaccurate, or misleading; are not unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation; are not obscene, lewd, lascivious, filthy, violent, harassing, libelous, slanderous, or otherwise objectionable (as determined by us); do not ridicule, mock, disparage, intimidate, or abuse anyone; are not used to harass or threaten (in the legal sense of those terms) any other person and to promote violence against a specific person or class of people; do not violate any applicable law, regulation, or rule; do not violate the privacy or publicity rights of any third party; do not violate any applicable law concerning child pornography, or otherwise intended to protect the health or well-being of minors; do not include any offensive comments that are connected to race, national origin, gender, sexual preference, or physical handicap; do not otherwise violate, or link to material that violates, any provision of these Legal Terms, or any applicable law or regulation.

Third-Party Websites and Content

The Services may include links to third-party websites and content (e.g., articles, graphics, videos) not controlled by us. We do not review or endorse these third-party sites or content and are not responsible for their accuracy, legality, or any issues that arise from their use. Accessing third-party websites or content is at your own risk, and our Legal Terms no longer apply. Review the terms and privacy policies of any third-party sites you visit or content you use. We are not liable for any transactions or interactions with third-party sites or content and disclaim any responsibility for losses or damages related to them.

General Terms and Law

This Agreement is governed by the laws of Ukraine. You acknowledge that no joint venture, partnership, employment, or agency relationship exists between you and Product Wait as a result of using these services. You agree not to represent yourself as a representative, agent, or employee of Product Wait. You agree that Product Wait will not be liable for any representation, act, or omission to act by you.
